States of Impunity: The Role of NGOs in Addressing Gross and Systematic Violations of the European Convention on Human Rights

Abstract:
This lecture examines the role of non-governmental organisations (‘NGOs’) in bringing before the European Court of Human Rights cases involving gross and systematic human rights violations. Empirical research highlights the fact that NGOs have a significant role to play in bringing such situations to the Court’s attention. In this paper, the reasons for this are explored through detailed examination of selected cases brought by the Kurdish Human Rights Project and the European Roma Rights Centre. It concludes that as a result of the systematic oppression experienced by minorities such as the Roma and the Kurds, an individualistic conception of litigation is inadequate. Furthermore, it argues that NGOs contribute towards the realisation of the Court’s constitutional function by placing systemic issues of exclusion and discrimination before it.

Direitos Humanos e Mobilização Jurídica Transnacional no Contexto Europeu
Apresentação:
Os processos de globalização têm vindo a promover a expansão dos sistemas regionais (Europeu, Interamericano e Africano) e global (ONU) de protecção dos direitos humanos. Ao lado das transformações das instituições e das normas internacionais de direitos humanos, verifica-se uma crescente mobilização jurídica transnacional dos direitos humanos. Faz-se necessário aprofundar a discussão sobre a emergência, o desenvolvimento e a mobilização dos sistemas de protecção dos direitos humanos. Até pouco tempo os direitos humanos restringiam-se às preocupações dos juristas. Nos últimos anos, porém, as Ciências Sociais têm vindo a dedicar maior atenção ao tema, examinando, por exemplo, os processos de legaliza&cccedil;ão, as políticas e as práticas de direitos humanos em diferentes escalas e em variados contextos económicos e socio-culturais.
De entre outras questões, indaga-se em que contexto os sistemas regionais e global de protecção dos direitos humanos surgiram e como têm vindo a desenvolver-se. Quais os seus limites e potencialidades para a efectiva promoção e protecção dos direitos humanos e dos direitos de cidadania? Como se relacionam com os Estados que os integram e com os sistemas jurídicos nacionais? Como os indivíduos, os grupos sociais, as empresas e as organizações não-governamentais mobilizam estes sistemas? Em que medida a mobilização jurídica transnacional dos direitos humanos contribui para a reconstrução do conteúdo dos direitos humanos, para a resignificação das violações de direitos humanos e para a constituição de novos sujeitos de direitos humanos?
Este Seminário pretende promover uma discussão sobre estas questões a partir de uma perspectiva multidisciplinar. Serão examinados os aspectos jurídicos, políticos e sociais do desenvolvimento e do uso do sistema europeu de protecção de direitos humanos, dando-se enfoque especial ao Tribunal Europeu dos Direitos Humanos e ao caso português.

The Politics of Human Rights, Transnational Activism and Justice
Abstract:
In the last twenty years, human rights values, language and norms have gained prominence in law, politics and social activism at local, national and international scales. The definition, legalization and implementation of human rights norms have become a central issue of social, legal and political practices. We have observed an increasing transnationalization of legal institutions and a growing number of individuals and organizations using international law to address conflicts over human rights in
different part of the world. The politics of human rights involves several types and levels of relationships: between local and international communities; between social, legal and political actors and institutions at the local, national, regional and transnational levels of interaction. Thus, the increasing engagement with the politics of human rights offers a unique opportunity to examine a set of complex relationships and conflicts in the current development of law, politics and transnational activism all over the world. This session seeks to promote a discussion on the ways in which the politics of human rights
relates to transnational activism and justice in their concrete embeddedness. How do social movement actors engage with human rights discourses and frameworks to foster their causes? How do they use human rights norms and approach (trans)national institutions created to protect human rights? How do legal and political actors and institutions participate in the field of human rights at both national and international levels of interactions? How does the politics of human rights relate to the development
of democracy? What are the contributions and limitations of the legalization of human rights in different cultural and political contexts? These are some of the questions that this workshop intends to address.
